Early Guilty Pleas

While it may seem counter-intuitive, there can be advantages in entering an early guilty plea. You could ultimately receive a lighter sentence than you would if you were found guilty after a trial. The law provides a reduction of up to 40% for guilty pleas in the Magistrate’s Court and up to 35% (or 25% for certain crimes) in the higher courts when there is an early guilty plea.

Each matter has to be weighed individually, and some of the key factors taken into account by a court when setting a reduction in sentence include:

  • When the guilty plea was made (the earlier in proceedings that you plead guilty, the greater the reduction you receive)
  • If the reduction is proportionate to the seriousness of the offence
  • The number of offences, and whether the defendant is pleading guilty to all of them
